Injured victims have filed lawsuits against the gadolinium contrast agent manufacturers seeking recovery for the severe side effects they have suffered. The most common type of injury alleged in the lawsuits include a rare disease called Nephrogenic Systemic Fibrosis (NSF), also known as Nephrogenic Fibrosing Dermopathy (NFD). A man in Philadelphia filed a lawsuit against General Electric Company, the maker of Omniscan The lawsuit alleges that the plaintiff developed NSF / NFD after receiving two injections of the gadolinium contrast dye during an MRI. The lawsuit claims Omniscan is defective because the chemical nature of the contrast agent causes the gadolinium to become free in the body. The lawsuit further claims that the defect makes it more likely that somebody with kidney problems, who cannot dispel the gadolinium from his body, will develop NSF / NFD. The lawsuit also alleges that the Gadolinium manufacturer failed to test the agent to see if it caused NSF / NFD and failed to warn users with kidney problems of the risk of developing NSF / NFD.
A lawyer in Florida recently filed a lawsuit against General Electric on behalf of an injured victim. The lawsuit alleges that the plaintiff developed NSF / NFD shortly after being injected with a gadolinium based contrast agent during an MRI. The lawsuit claims the Gadolinium contrast agent was unreasonably dangerous to patients with kidney problems or renal failure because the gadolinium can only be eliminated through the kidneys. The lawsuit further claims the manufacturer was required to warn patients of this increased risk to patients with kidney problems.
There are currently 68 lawsuits filed on behalf of injured victims diagnosed with NSF/NFD against the gadolinium based contrast agent manufacturers. The U.S. Judicial Panel on Multidistrict Litigation (MDL) ruled that all litigation against the makers of gadolinium will be centralized in the U.S. District Court for the Northern District of Ohio. This type of litigation coordination proceeding is common when there are many plaintiffs filing lawsuits against a few defendants with common issues of fact and law. An MDL proceeding potentially speeds up the litigation process and could lead to quicker trials and settlements for victims.
