Kugel Mesh Hernia Patch Lawsuits 

Bard Inc., the manufacturer of the Composix Kugel Mesh Hernia Patch, currently faces at least 300 lawsuits from patients claiming injuries from the Kugel Mesh Hernia Patch. The lawsuits stem from defects in certain Composix Kugel Mesh Hernia Patches that cause them to break or migrate once surgically implanted in patients’ bodies. This defect can cause serious and sometimes fatal injuries. In an October 2007 Securities and Exchange Commission (SEC) report, Bard stated that about 180 federal lawsuits and 60 state lawsuits had been filed against the company. Bard also reported that there were 9 pending class action lawsuits as of September 30, 2007. Since the number of Kugel Mesh Hernia Patch lawsuits were reported, attorneys have filed at least 84 additional lawsuits on behalf of injured plaintiffs against Bard. According to Bard, the company does not know exactly how many lawsuits involving the Composix Kugel Mesh Hernia Patch it will ultimately face.

While the Bard Composix Kugel Mesh Hernia Patch was subject to 3 different recalls between December 2005 and January 2007, lawsuits claim that Bard knew about serious problems with the patch even before the recalls and continued to sell the patches anyway. In fact, according to the lawsuits, Food and Drug Administration (FDA) records indicate that Bard officials began to receive complaints about broken memory recoil rings in the “extra large” Composix Kugel Mesh Hernia Patches as early as 2002. Moreover, the lawsuits allege that some of the hernia patch complaints suggested serious injuries might occur because the device sometimes ruptured, puncturing internal organs and allowing mesh to block adjacent bowels in some patients. Yet, Bard did not begin to pull certain Composix Kugel Mesh Hernia Patches from the market until late 2005.
 
Lawsuits against Bard allege that patients across the U.S. have suffered problems after being implanted with the Kugel Mesh Hernia Patch. These lawsuits assert that many patients could have been saved from undergoing additional surgeries, complications and prolonged pain had Bard adequately tested the patch before releasing it to the public. Further, lawsuits assert that Bard has not adequately notified patients and doctors about the multiple recalls and that other non-recalled Kugel Mesh Hernia Patches may also be defective. Some speculate that injured patients who have filed lawsuits against Bard could recover up to seven figures in compensation from these lawsuits.
