Rovner v. Just Energy, et al.

Bernstein Liehbard represents a proposed class of natural gas consumers in New York in Rovner v. Just Energy, et al., No. 18-cv-02159-ENV-CLP (E.D.N.Y.), a consumer class action filed against Just Energy, an Energy Services Company (“ESCO”), and National Grid, a utility company, operating in New York State.  The plaintiffs allege, inter alia, that defendants violated the State of New York Public Services Commission’s Uniform Business Practices by deceptively omitting the price “per therm” that Just Energy charged for natural gas from the monthly consolidated billing statements that defendants sent to consumers. Plaintiffs allege claims under New York’s General Business Law §§ 349 and 349-d, breach of contract, breach of the implied covenant of good faith and fair dealing, and unjust enrichment.  The action is pending.
