In re: SCANA Corporation Derivative Litigation

Bernstein Liebhard is co-lead counsel representing an individual plaintiff in a derivative action entitled In re: SCANA Corporation Derivative Litigation, No. 17-cv-03166-MBS (D. S. Car.).  Plaintiffs allege that certain directors and officers of SCANA Corporation breached their fiduciary duties to the company by overseeing the disastrous construction of two nuclear reactors at the V.C. Summer Nuclear Station, a project which they eventually abandoned, costing SCANA almost $10 billion.  In June 2018, the court denied defendants’ motions to dismiss the complaint. The court subsequently denied defendants’ motion to stay the case pending SCANA’s upcoming merger with Dominion Energy on October 31, 2018.  The action is pending.
