On July 6, 2015, Bernstein Liebhard filed an antitrust class action complaint in the United States District Court for the District of Columbia alleging a conspiracy among domestic airlines. The firm filed on behalf of an individual plaintiff and a putative class of direct purchasers of domestic airline tickets from Defendants American Airlines, Inc., Delta Airlines, Inc., Southwest Airlines Co., and United Airlines, Inc. (collectively “Defendants”). The complaint alleges that Defendants conspired to fix, raise, maintain or stabilize the price of domestic airline tickets in violation of Section 1 of the Sherman Act. Defendants effectuated this conspiracy through a number of mechanisms, including by constraining the seating capacity on flights within the United States; limiting the number of flights offered within the United States; and limiting the transparency of pricing information available to domestic airline ticket consumers regarding flights within the United States.
